이용약관

제1조 (목적)

이 약관은 뮤직온느(이하 "회사")가 제공하는 VVERS Visualizer 서비스(studio.vvers.com, 이하 "서비스")의 이용 조건과 절차, 회사와 이용자의 권리 · 의무를 정합니다.

제2조 (서비스 내용)

서비스는 이용자가 올린 음원과 MIDI 파일로 리듬게임 형식의 비주얼라이저 영상을 만드는 웹 서비스입니다. 파일 분석과 영상 제작은 이용자의 브라우저에서 이루어지며, 올린 파일은 회사 서버에 저장되지 않습니다.

제3조 (약관의 효력과 변경)

1. 이 약관은 서비스 화면에 게시하여 효력이 생깁니다.
2. 회사는 관련 법령을 위반하지 않는 범위에서 약관을 바꿀 수 있으며, 바꾸는 경우 시행 7일 전(이용자에게 불리한 경우 30일 전)부터 서비스 화면에 알립니다.

제4조 (회원가입과 계정)

1. 회원가입은 Google 계정 로그인으로 하며, 처음 로그인할 때 이 약관과 개인정보처리방침에 동의한 것으로 봅니다.
2. 만 14세 미만은 회원가입을 할 수 없습니다.
3. 계정은 본인만 사용해야 하며, 다른 사람과 공유하거나 양도 · 판매할 수 없습니다.
4. 이용자는 언제든지 문의 메일로 회원 탈퇴를 요청할 수 있습니다.

제5조 (무료 체험과 유료 이용권)

1. 무료 체험은 로그인 없이 이용할 수 있으며, 일부 기능과 영상 길이 · 화질이 제한되고 영상에 워터마크가 들어갑니다.
2. 유료 이용권(월 · 연 구독 등)의 종류, 가격, 제공 기능은 결제 화면에 표시합니다.
3. 유료 이용권은 결제가 확인된 즉시 계정에 적용됩니다.

제6조 (자동 갱신과 해지)

1. 구독형 이용권은 해지하지 않으면 이용 기간이 끝날 때 같은 조건으로 자동 결제 · 갱신됩니다. 가격을 바꾸는 경우 다음 결제 전에 미리 알립니다.
2. 이용자는 언제든지 해지할 수 있으며, 해지하면 다음 결제부터 청구되지 않고 이미 결제한 기간이 끝날 때까지 유료 기능을 이용할 수 있습니다.

제7조 (청약철회와 환불)

1. 유료 이용권은 결제 즉시 제공이 시작되는 디지털 콘텐츠이며, 회사는 결제 전에 기능을 미리 써볼 수 있도록 무료 체험을 제공합니다. 따라서 「전자상거래 등에서의 소비자보호에 관한 법률」 제17조 제2항 제5호에 따라, 결제 후에는 청약철회(환불)가 제한됩니다. 회사는 이 내용을 결제 화면에 미리 알립니다.
2. 다만 회사의 책임으로 서비스를 정상적으로 이용할 수 없는 경우, 또는 중복 결제 등 결제 오류가 있는 경우에는 확인 후 이용하지 못한 기간이나 잘못 결제된 금액을 환불합니다.
3. 해외 이용자의 경우에도 이용자 거주 국가의 법률이 강제로 정한 권리는 이 조항으로 제한되지 않습니다.

제8조 (이용자 콘텐츠와 만든 영상의 권리)

1. 이용자가 올린 음원 · MIDI와 서비스로 만든 영상에 대한 권리는 이용자(또는 원래 권리자)에게 있습니다. 회사는 이 파일을 받거나 저장하지 않습니다.
2. 이용자는 자신이 권리를 가지거나 사용 허락을 받은 음원과 MIDI만 사용해야 하며, 이를 어겨 생기는 문제는 이용자가 책임집니다.
3. 유료 이용권으로 만든 영상은 SNS 게시, 광고 등 상업적 용도로 사용할 수 있습니다. 무료 체험으로 만든 영상은 워터마크를 지우거나 가리지 않는 조건으로 사용할 수 있습니다.

제9조 (서비스의 권리와 금지 행위)

서비스의 디자인, 프로그램, 화면 구성 등에 대한 권리는 회사에 있습니다. 이용자는 다음 행위를 해서는 안 됩니다.

• 계정 공유, 이용권의 무단 재판매
• 서비스 프로그램의 복제 · 변조 · 역설계, 유료 기능 제한을 우회하는 행위
• 서비스 운영을 방해하거나 다른 사람의 권리를 침해하는 행위

이를 어기는 경우 회사는 미리 알린 뒤 이용을 제한하거나 계정을 해지할 수 있습니다.

제10조 (서비스 변경 · 중단)

1. 회사는 기능 개선을 위해 서비스를 바꿀 수 있으며, 중요한 변경은 미리 알립니다.
2. 설비 점검, 장애, 천재지변 등으로 서비스가 일시 중단될 수 있습니다. 회사의 책임으로 유료 이용권을 일정 기간 이상 이용하지 못한 경우 그 기간만큼 연장하거나 환불합니다.
3. 서비스를 종료하는 경우 30일 전에 알리고, 남은 유료 기간에 대해서는 환불합니다.

제11조 (책임의 제한)

회사는 이용자의 브라우저 · 컴퓨터 환경, 이용자가 올린 파일의 문제, 이용자의 귀책 사유로 생긴 손해에 대해서는 책임지지 않습니다. 단, 회사의 고의 또는 중대한 과실로 인한 손해는 예외로 합니다.

제12조 (준거법과 분쟁 해결)

이 약관은 대한민국 법률을 따르며, 분쟁이 생기면 먼저 성실히 협의합니다. 소송이 필요한 경우 민사소송법에 따른 관할 법원으로 합니다.

Terms of Service

1. About these terms

These terms govern your use of VVERS Visualizer at studio.vvers.com (the "Service"), run by Musiconne ("뮤직온느", "we"). This English version is provided for convenience; if it differs from the Korean version, the Korean version applies.

2. The Service

The Service turns your audio and MIDI files into rhythm-game style visualizer videos. Analysis and video making happen in your browser; the files you add are not stored on our servers.

3. Changes to these terms

We may update these terms within the limits of the law. We will announce changes in the Service at least 7 days before they take effect (30 days for changes that are less favourable to you).

4. Accounts

• You sign up by signing in with Google; by signing in for the first time you agree to these terms and the Privacy Policy.
• You must be 14 or older.
• Your account is for you alone. Don't share, transfer or sell it.
• You can ask us to delete your account at any time by email.

5. Free trial and paid plans

• The free trial works without signing in. Some features, video length and quality are limited, and videos carry a watermark.
• Paid plans (for example monthly or yearly subscriptions), their prices and features are shown on the checkout page.
• A paid plan is applied to your account as soon as payment is confirmed.

6. Renewal and cancellation

• Subscriptions renew automatically at the end of each period on the same terms unless you cancel. We will tell you before any price change applies to your next payment.
• You can cancel at any time. After cancelling you won't be charged again, and you keep paid features until the end of the period you have paid for.

7. Refunds

• Paid plans are digital services that start as soon as you pay, and we offer a free trial so you can try the features first. For this reason payments are non-refundable, as permitted by Korean consumer protection law (Act on the Consumer Protection in Electronic Commerce, Article 17(2)5). We show this notice before you pay.
• If you can't use the Service because of a fault on our side, or you were charged twice or incorrectly, we will refund the affected amount after checking.
• Nothing in these terms limits rights that the laws of your country give you and that cannot be waived.

8. Your content and your videos

• Rights in the audio and MIDI you add, and in the videos you make, stay with you (or the original rights holder). We do not receive or store these files.
• Only use audio and MIDI you own or have permission to use. You are responsible for any claims arising from content you use.
• Videos made with a paid plan may be used commercially, including on social media and in ads. Videos made with the free trial may be used as long as the watermark is not removed or hidden.

9. Our rights and prohibited use

We own the Service's design, software and interface. You must not:

• share accounts or resell plans
• copy, modify or reverse-engineer the Service, or work around paid-feature limits
• disrupt the Service or infringe others' rights

If you do, we may restrict or close your account after notice.

10. Changes and interruptions

• We may change features to improve the Service and will announce important changes in advance.
• The Service may be briefly unavailable for maintenance, outages or events beyond our control. If a fault on our side keeps you from using a paid plan for a meaningful period, we will extend your plan by that time or refund it.
• If we close the Service, we will give 30 days' notice and refund unused paid time.

11. Limitation of liability

We are not liable for losses caused by your browser or computer, by the files you add, or by your own actions, except for losses caused by our intent or gross negligence.

12. Governing law

These terms are governed by the laws of the Republic of Korea. We will first try to resolve any dispute in good faith; otherwise the competent court under the Korean Civil Procedure Act has jurisdiction.
